The Burial. Based on a real case. [ENG-ESP]

In Mississippi in 1995, a small businessman, owner of a family-owned funeral home, decides not to let himself go bankrupt and takes a large group in the same industry to court for breach of contract. The statistics obviously say that it is a lost case because this large consortium has all the resources to tear the small businessman to shreds, but it does not have to be so, because you just need to know how to handle the courts and have a good lawyer.

En Misisipi de 1995, un pequeño empresario, propietario de una funeraria familiar, decide no dejarse caer en la quiebra y llevar a juicio a un gran grupo del mismo ramo por incumpliendo de contrato. La estadística evidentemente dice que es un caso perdido ya que este gran consorcio tiene todos los recursos para hacer trizas al pequeño empresario, pero no tiene porque ser así, porque solo se necesita conocer como se manejan los juzgado y tener un buen abogado.

Jeremiah O’Keefe, played by Tommy Lee Jones, is the owner of this small family business founded more than 50 years ago. He is an old man who only wants to leave a legacy to his family, his 13 children and grandchildren, but in recent years he has had a difficult economic situation and now they are about to take away his business. His lawyer proposes a meeting with the owner of the Loewen Group, who have been buying up small funeral homes in various parts of the country and are interested in his business.

The idea is not to sell the entire company, but only those necessary to get out of debt and save the company, which has several branches within the state, including insurance companies. O’Keefe offers this magnate to sell part of the business in exchange for having a monopoly on the sale of funeral insurance. Apparently everything went as expected, but as time goes by O’Keefe has no more reason from the buyers and also the creditors visit him.

Everything seems to have been duped and the Loewen Group representatives did nothing more than buy time for the state to take the company away from O’Keefe so that they could buy it back at a lower price. This man, determined to keep his company and refusing to be swindled, filed a complaint in court.

Es un anciano que sólo quiere dejar un legado a su familia, sus 13 hijos y nietos, pero en los últimos años ha pasado por una difícil situación económica y ahora están a punto de quitarle el negocio. Su abogado le propone una reunión con el dueño del Grupo Loewen, que ha estado comprando pequeñas funerarias en varias partes del país y está interesado en su negocio.

La idea no es vender toda la empresa, sino sólo las necesarias para salir de deudas y salvar la compañía, que tiene varias sucursales en el Estado, incluidas compañías de seguros. O’Keefe ofrece a este magnate vender parte del negocio a cambio de tener el monopolio de la venta de seguros funerarios. Aparentemente todo ha ido como se esperaba, pero a medida que pasa el tiempo O'Keefe no tiene más razón por parte de los compradores y además le visitan los acreedores.

Todo parece haber sido un engaño y los representantes del Grupo Loewen no hicieron más que ganar tiempo para que el Estado le quitara la empresa a O’Keefe y así poder recomprarla a un precio más bajo. Este hombre, decidido a conservar su empresa y negándose a ser estafado, presentó una denuncia ante los tribunales.

Now how comes Wille Gary played masterfully by Jamie Foxx to become his lawyer. Well, it turns out that Gary is a media lawyer from Florida, specializing in cases that have nothing to do with contracts. He likes the fame and even has TV hype because he considers himself one of the best litigators having won all his cases. O’Keefe’s attorney of over 30 years is white, yes, white, and it just so happens that in this movie they touch on the issue of race difference and how important it was to the resolution of this case.

The lawyer’s assistant Hal Dickins (played by Mamoudou Athei) is dark-skinned and realices that the courthouse where the trial will take place is in an area where most of the population is dark-skinned, so he does not think that the lawyer Mike Allred (played by Alan Ruck) is the best candidate to stand in front of a courthouse full of dark-skinned people and suggests O’Keefe to visit Gary.

That he accepted the case was another challenge, since up to that moment he presented himself as they would say in my town as a pessimistic lawyer, besides he does not accept cases where he can lose and this one would not be easy, totally the opposite of what he was used to, but after listening to the reasons and the benefit he could achieve he is convinced and accepts to be part of the case. He does not like to lose so he has to work and use all his strategies in front and behind the court to achieve his goal. He is a man as I said mediatic and charismatic.

But O’Keefe is not the only one looking for good lawyers because the opposing side when analyzing the situation, the geographical area they are in and the reasons why Willie Gary is in Mississippi, they also hire only dark race lawyers. It is a movie where this issue takes a lot of importance but even though it is something I had to mention and I feel it is racism but in an inverted way to what we are used to see and hear, I am not going to delve too much into this issue.

Ahora bien, cómo llega Wille Gary interpretado magistralmente por Jamie Foxx a convertirse en su abogado. Pues resulta que Gary es un abogado mediático de Florida, especializado en casos que no tienen nada que ver con contratos. Le gusta la fama e incluso tiene bombo televisivo porque se considera uno de los mejores litigantes habiendo ganado todos sus casos. El abogado de O’Keefe desde hace más de 30 años es blanco, sí, blanco, y da la casualidad de que en esta película tocan el tema de la diferencia de razas y lo importante que fue para la resolución de este caso.

El ayudante del abogado, Hal Dickins (interpretado por Mamoudou Athei), es de piel oscura y se da cuenta de que el juzgado donde tendrá lugar el juicio está en una zona donde la mayoría de la población es de piel oscura, por lo que no cree que el abogado Mike Allred (interpretado por Alan Ruck) sea el mejor candidato para ponerse al frente de un juzgado lleno de gente de piel oscura y sugiere a O’Keefe que visite a Gary.

Que aceptara el caso fue otro reto, ya que hasta ese momento se presentaba como dirían en mi pueblo como un abogado pesimista, además no acepta casos donde pueda perder y este no sería fácil, totalmente lo contrario a lo que estaba acostumbrado, pero después de escuchar las razones y el beneficio que podría lograr se convence y acepta ser parte del caso. No le gusta perder así que tiene que trabajar y utilizar todas sus estrategias delante y detrás del tribunal para conseguir su objetivo. Es un hombre como he dicho mediático y carismático.

Pero O’Keefe no es el único que busca buenos abogados porque la parte contraria al analizar la situación, la zona geográfica en la que se encuentran y las razones por las que Willie Gary está en Mississippi, también contratan solo abogados de raza oscura. Es una película donde este tema toma mucha importancia pero aunque es algo que tenía que mencionar y siento que es racismo pero de una manera invertida a lo que estamos acostumbrados a ver y escuchar, no voy a ahondar demasiado en este tema.

It is an excellent film, because we can see how each of the parties studies the ways and the information they are going to use to compromise the image of the other party in front of the court, which is generally formed by common people belonging to the community, so it is important to appeal to social feelings and pains, if something affects society in general it could be a positive point to use and that will leave the other party with a very bad image. The results, although almost impossible to achieve, were as expected. At present this Loewen group does not exist since it declared bankruptcy. The truth is that he who goes wrong, goes wrong.

Es una excelente película, porque podemos ver como cada una de las partes estudia las formas y la información que van a utilizar para comprometer la imagen de la otra parte frente al tribunal, que generalmente está formado por personas comunes pertenecientes a la comunidad, por lo que es importante apelar a los sentimientos y dolores sociales, si algo afecta a la sociedad en general puede ser un punto positivo a utilizar y que dejará a la otra parte con una muy mala imagen. Los resultados, aunque casi imposibles de conseguir, fueron los esperados. En la actualidad este grupo Loewen no existe ya que se declaró en quiebra. Lo cierto es que el que obra mal, le va mal.
